Please read these Terms and Conditions (“Agreement”, “Terms and Conditions”) carefully before using TAP Academy’s website or any sub-site (“the website”, “the site”) operated by TAP Academy (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the website.

By accessing or using the website in any manner, including, but not limited to, visiting or browsing the website or contributing content or other materials to the website, you agree to be bound by this terms and conditions.

The website and its original content, features and functionality are owned by TAP Academy and are protected by intellectual property or proprietary rights laws.

We may terminate your access to the website, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature shall survive termination, including, without limitation, ownership provisions, warranty, disclaimers, indemnity and limitations of liability.

By clicking the ‘Accept’ button you agree to these terms and conditions. By completing and submitting the electronic order form (or proceeding through the ‘checkout process’) & or by speaking to a TAP Academy representative you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. Neither submitting an electronic order form nor completing the checkout process constitutes our acceptance of your order.

Our Site may contain links to third-party sites that are not owned or controlled by TAP Academy. We have no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Canada, without giving effect to any principles of conflicts of law.

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.

User ID Password you registered for TAP Academy you were given a user name and password. You must take care to keep your user name and password confidential. You will be responsible for all activities that occur under your user name and password. You must not allow anyone else to use your user name and password. You must inform us immediately of any unauthorized use of your user name or password or if you believe that your user name or password has been compromised. We reserve the right to require you to change your user name and password if we believe that they are no longer secure.

We will never email you or ask you on the phone for your password. If anyone asks you for your password you must inform us immediately.

We will provide you with access to your course once you have enrolled and completed payment. You will need to log on using your user name and password to use the course.

Privacy and data protection is as described in the TAP Academy’s Privacy Policy.

We endeavor to provide you with your chosen training and any supporting materials such as login details, certificates etc. to arrive within 5 business days from the registration date, TAP Academy will not accept any claim from the delay of such materials due to circumstances beyond its control until the 5 days period has expired, at which point at the absolute discretion of TAP Academy will compensation be considered up to a maximum of the course cost. Please note: should your voucher code expire, it can be reactivated for an extension fee of $250.00 CAD for 3 months or $350.00 CAD for 6 months

Access to Website, Server and Course Improvement
As we are continually improving and upgrading our courses and security there may be an occasion where you will be unable to access your course. Please be assured that this time will be kept to a minimum and is in the interest of our learners. We strive to supply our students with the latest, up to date courses that are in demand today.

However as we supply a number of training courses in the world’s fastest changing industry today, there can be periods between the creation of new software, hardware, certifications and the release of a fully functional interactive training course that will meet our high standards.

A course becoming ‘out of date’ can also be due to the awarding body deciding to alter, change, replace or simply cease the exam. These events are beyond the control of TAP Academy and hence we cannot accept any responsibility for any previously purchased course becoming invalid for certification purposes. Moreover, it is to be noted that a portion of TAP Academy’s courses are supplied by third parties. While we cannot guarantee that third party companies will always remain solvent, we carefully scrutinize our suppliers before adding their courses to our catalogues. In case a third-party supplier cease to offer courses for any reason, e-Careers will use their best endeavors to replace students courses on a like for like basis free of charge.

CANCELLATIONS AND REFUND POLICY
Under this policy, you may cancel your purchase of the course within the period of 7 calendar days from the date on which the contract of purchase is concluded. This is called as a “Cancellation Period”.

Note that if your license voucher is activated during the Cancellation Period, you expressly request us to begin providing the course materials and you acknowledge that you lose your right to cancel the purchase of the course and get any refund for it.

In case you decide to cancel your purchase of a course, it can be done in following way:
By sending us a written cancellation request to admin@tapacademy.ca cancellation by phone or any other mean not in writing will not be accepted

If you cancel the purchase of a course within 7 calendar days and without activation of your license voucher as mentioned above, we will refund you for all payments made as a part of your purchase within 14 calendar days from the day we accept that you are entitled to a refund.

Note:
All external exam vouchers must be used within 12 months of purchase. Please refer to the individual exams for validity as some of the exam vouchers are valid for 3 months only.

Although TAP Academy strives to offer the best prices, on occasion, as some courses are externally sourced, our prices may be above that of our suppliers. If you have purchased one of our courses and subsequently found it cheaper elsewhere, this reason alone, you will not be eligible for a refund.

Before you purchase a course from us, it is your responsibility to ensure that the course is right for you. Our website displays relevant information on all the courses and moreover for some courses even demos are available. However, it is to be noted that by not having access to a demo, will not give rights for cancellation.

The detailed course information is designed to reduce the risk of you making the wrong choice. Read the course description and technical requirements.

Do note that as some of the courses are sourced by us, you will be required to respond to communication from our suppliers in order to gain access to the course(s) you have purchased. Furthermore, please note that usually e-Careers can support any course access or user issues, however in the rare instances, we may need to contact our third-party developers on your behalf and this may take up to 7 to 10 workings days to gain a solution.

About ‘Deposit’ you should be aware that a deposit is a part-payment for the service (course in our case). When you pay a deposit, it shows that you intend to buy a course and wish to enter into a contract with us. Please remember that deposits are non-refundable in nature unless statutory rights are applicable whereby we are satisfied that it meets all the necessary requirements for it.

Refund or returns on physical goods
If you are not satisfied with your purchase, we will issue you with a refund, in accordance with the terms and conditions.

A full refund (excluding original delivery charge) will only be issued if we receive in writing your intent to cancel your purchase within 5 days, there is a cancellation fee of $50.00 CAD on any course refund. Please include your payment receipt on all refund or cancellations.

How long will it take to process my return?
Please allow 5 working days for cancellations to be processed once they reach us and a further 14 days for any refund to appear in your account.

Course completion certificates are emailed within 30 days of completion of your course, please note there are no certificated issued for refreshers courses, as these are prep courses. Additional copies of Certificate of Completion may be requested for a fee of $25.00

Security and Credit / Debit Cards
We use all of the standard security measures to guard your personal data. Credit / debit card numbers are not stored on to any of our system. For security reasons, we will never re-display entire card numbers in a readable form and all of the card transactions will be handled by our secure server. We do not offer non-secure transactions. We use secure methods to process the payments via card and on a regular basis monitor the performance of this process. Each time you make a card transaction, you will be sent confirmation of payment via e-mail.

Voucher Customers
Vouchers have a set limited redemption date (agreed with the voucher supplier and TAP academy). These vouchers once expired have no value to us. Should you hold an expired voucher, please talk to us and we will try and help.

We do not add any extra charges for training and any voucher purchase other than stated on the course, however Canadian (PST &GST)taxes are applicable for residents of British Columbia and GST only for all others

By agreement upon purchase you will be issued with a voucher and instructions to redeem the voucher to obtain access to your course.
